Overview
This website is operated by Cavaier AB ("Cavaier", "we", "us", or "our"), a company registered in Sweden (org. nr 559267-9541, VAT SE559267954101), Birger Dahlerus Väg 12, 176 69 Järfälla, Sweden. We offer this website, including all information, tools and services available from it, conditioned on your acceptance of the terms, conditions, policies and notices stated here.
By visiting our site or buying from us, you engage in our "Service" and agree to these Terms of Service ("Terms"), including the additional policies referenced here (such as our Returns, Refunds & Consumer Rights policy and our Privacy Policy). These Terms apply to all users of the site. Please read them carefully. If you do not agree to them, do not use the site.
These Terms apply to orders placed on cavaier.com and our country-specific domains. They do not apply to orders placed on us.cavaier.com (United States), which operates under its own separate terms.
Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell to you.
Your rights as a consumer
If you are a consumer (a person acting outside a trade or profession), you have mandatory rights under the law that cannot be excluded or limited by these Terms. In particular:
- You have a right of withdrawal (EU/EEA) or cancellation (UK) and a legal guarantee for faulty goods, as set out in our Returns, Refunds & Consumer Rights policy.
- You keep the protection of the mandatory consumer law of the country where you live.
Nothing in these Terms removes or reduces these rights. Where any term conflicts with mandatory consumer law that applies to you, that law prevails and the term applies only to the extent permitted.
Section 1 — Online store terms
By using the Service you confirm that you are at least 18 years old (the age of majority in Sweden), or that you have the consent of a parent or guardian to use the site. We do not knowingly sell to minors without such consent; an order placed by a minor without it may be cancelled, and a parent or guardian may contact us to unwind the purchase.
You may not use our products for any unlawful purpose, violate any laws in your jurisdiction (including copyright laws), or transmit any malicious code. A breach of these Terms may result in termination of your access to the Service.
Section 2 — General conditions
We reserve the right to refuse or cancel service for legitimate reasons (such as suspected fraud, unlawful use, or breach of these Terms). You understand that your content (excluding payment card details, which are always encrypted in transit) may be transferred unencrypted over networks and adapted to technical requirements. You agree not to reproduce, copy, sell or exploit any part of the Service without our written permission.
Section 3 — Accuracy of information
The material on this site is provided for general information and may not always be complete or current. We may update the contents of the site at any time but are not obliged to. This does not affect our obligations to you as a consumer, including the accuracy of the information we are legally required to provide before you place an order.
Section 4 — Prices and changes to the Service
Prices may change over time; however, the price that applies to your order is the price displayed at the time you place it. The total price payable, including any applicable taxes, and any shipping costs, are shown to you before you complete your order. Depending on your country, taxes or import charges may be included in the price or added at checkout or on delivery. We may modify or discontinue products or parts of the Service. Where you have already placed an order, any change to that order is governed by the section on errors below and by your statutory rights.
Section 5 — Products
We try to display product colours and images as accurately as possible but cannot guarantee your screen will show them accurately. Products may have limited quantities and are subject to our Returns, Refunds & Consumer Rights policy. We may limit sales of our products to any person, region or jurisdiction on a case-by-case basis.
Section 6 — Billing and account information
We may refuse or, for legitimate reasons, limit or cancel an order (for example, where it appears to be placed by a reseller, or where there is suspected fraud or a pricing error). If we change or cancel an order, we will try to contact you using the details you provided, and we will refund any amount you have paid for a cancelled order. You agree to provide current, complete and accurate purchase and account information.
Section 7 — Optional tools and third-party services
We may give you access to third-party tools that we do not control, provided "as is". We are not responsible for your use of optional third-party tools; please review the relevant provider's terms.
Section 8 — Third-party links
Our Service may include links to third-party sites we do not control. We are not responsible for their content or practices. Please review their policies before transacting with them. This does not limit your statutory rights against us for products we sell to you.
Section 9 — User comments and submissions
If you send us comments, ideas or suggestions, you agree we may use them without restriction or compensation, and that we are under no obligation to keep them confidential. Your comments must not be unlawful, infringe any third party's rights, or contain malicious code, and you must not misrepresent your identity. You are responsible for the comments you make.
Section 10 — Personal information
Your submission of personal data through the store is governed by our Privacy Policy, which explains how we collect, use and protect your data and your rights under the GDPR.
Section 11 — Errors, inaccuracies and omissions
Occasionally information on the site may contain errors relating to descriptions, pricing, promotions or availability. Where an order is affected by an obvious or manifest error (for example, a clearly incorrect price), we may correct it or cancel the order and refund you in full, even after the order is placed. We will not cancel an order simply because a price has since changed. This does not affect your statutory rights.
Section 12 — Prohibited uses
You may not use the site or its content: for any unlawful purpose; to solicit unlawful acts; to violate any applicable laws or regulations; to infringe intellectual-property rights; to harass, abuse or discriminate against anyone; to submit false information; to upload malicious code; to collect others' personal information; to spam or scrape; for any obscene purpose; or to interfere with the security of the Service. We may terminate your use of the Service for any prohibited use.
Section 13 — Disclaimer and limitation of liability
Except as expressly stated by us and except for your mandatory rights as a consumer, the Service and the products supplied through it are provided without warranties of any kind, to the maximum extent permitted by law. We do not guarantee that the Service will be uninterrupted, secure or error-free.
To the maximum extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Service.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, for defective products under applicable product-liability law, for breach of the statutory guarantees that apply to goods sold to consumers, or for any other liability that cannot be excluded or limited under the law applicable to you. For consumers, the limitations in this section apply only to the extent permitted by mandatory consumer law and do not affect your statutory rights.
Section 14 — Indemnification
If you are a business user, you agree to indemnify and hold harmless Cavaier AB and its officers, employees and partners from any claim arising out of your breach of these Terms or your violation of any law or third-party right. This indemnity does not apply to consumers beyond what is permitted by law.
Section 15 — Severability
If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the fullest extent permitted, and the remaining provisions will continue in force.
Section 16 — Termination
These Terms are effective until terminated by either you or us. You may terminate at any time by ceasing to use the site. We may terminate or suspend access where you breach these Terms, without affecting amounts due up to termination. Obligations incurred before termination survive it.
Section 17 — Entire agreement
These Terms and the policies referenced in them constitute the entire agreement between you and us regarding the Service, superseding prior agreements — except that nothing in this section overrides your mandatory statutory rights as a consumer.
Section 18 — Governing law
These Terms are governed by the laws of Sweden. If you are a consumer, you also benefit from the mandatory provisions of the law of the country where you live, and nothing in these Terms deprives you of that protection. Disputes may be referred to the alternative dispute resolution bodies described in our Returns, Refunds & Consumer Rights policy.
Section 19 — Changes to these Terms
You can review the current version of these Terms on this page at any time. We may update them by posting changes here. Changes apply to orders placed after they are posted; they do not retroactively reduce your rights on an order already placed.
Section 20 — Faulty goods and your legal guarantee
Goods sold to consumers come with the statutory guarantees required by law, including that they conform to their description and are of satisfactory quality. Your remedies for faulty or non-conforming goods — repair, replacement, price reduction or refund — are set out in full in our Returns, Refunds & Consumer Rights policy. These statutory rights cannot be excluded and are not limited by any other provision of these Terms.
Section 21 — Intellectual property
All content on this site — including the "Cavaier" name and logo, product and lifestyle images, text, graphics, and the design of the jewelry and the site — is owned by Cavaier AB or used under licence, and is protected by trade mark, copyright and other intellectual-property laws.
The "Cavaier" word mark and the Cavaier logo are registered European Union trade marks owned by Cavaier AB:

You may not copy, reproduce, distribute, sell, or otherwise use our name, logo, designs, images or other content, in whole or in part, without our prior written permission.
